TERMS AND CONDITIONS


CONTRACTUAL RELATIONSHIP

Dharmaz Enterprise, having its registered office at Bizna, Kalyani Expressway, Halisahar, West Bengal – 743166, provides comprehensive automobile care services including car washing, detailing, tyre & battery services, and other related automotive solutions. The use and access of our website www.dharmaz.in (“Website”), our digital platform, and any services or products associated with the Website (“Services”) shall be governed by these Terms and Conditions (“Terms”). The Website and the digital service platform shall together be referred to as the “Platform”.

These Terms constitute a legally binding agreement between Dharmaz Enterprise (“Company”, “we”, “us”, “our”) and its users (“User”, “you”, “your”) governing your use of the Platform to browse and/or avail Services. By accessing or using the Platform, you agree to these Terms. If you do not agree, you must stop using the Platform. These Terms supersede all previous written agreements with you.

The Company reserves the right to modify or amend these Terms without prior notice. Updated Terms shall be posted on the Platform and continued usage of the Platform after updates will constitute your acceptance of the revised Terms. These Terms are an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature.

DEFINITIONS

“Content” includes (but is not limited to) reviews, images, videos, location data, feedback, ratings, and other information displayed or submitted on the Platform.

“User Content” means any Content uploaded or shared by the User through the Platform.

“Dharmaz Content” means content created by the Company including graphics, software, code, interface design, and product/service data, excluding User Content.

“Estimated Cost” means an indicative price approximation provided by third-party service providers for required automotive work.

“Service(s)” refers to all automobile-related offerings provided through the Platform, including but not limited to detailing, washing, tyre & battery services, polishing, etc.

“User” refers to any individual car owner or authorized person who is registered on the Platform and avails the Services.

SERVICES

The Platform enables Users to arrange automotive services through independent third-party service providers. Once a request is submitted, the Platform may display suitable service providers based on User preferences.

You acknowledge and agree that Dharmaz Enterprise does not itself perform automobile repair or detailing services and that these Services are provided by independent third-party contractors.

Estimated pricing and service timelines provided are indicative and may vary depending on actual vehicle condition and requirements.

ELIGIBILITY

By using the Platform, you confirm that you are 18 years of age or above and are competent to enter into a legally binding contract. If you access our Services on behalf of an organization, you confirm that you are authorized to represent that organization.

USE OF SERVICES

You must create a User account to access certain features of the Platform. You are responsible for maintaining confidentiality of your login credentials and are fully responsible for activities carried out under your account.

Users may:

  1. Search for service providers and view their details
  2. Post reviews and feedback after availing a service

Users must only post genuine reviews and must not misuse the platform for false complaints or defamatory submissions.

PROHIBITED USAGE OF THE PLATFORM

Users are prohibited from performing unlawful or abusive activities including but not limited to:

  1. Tampering with Platform security
  2. Uploading incorrect or misleading information
  3. Unauthorized automated data scraping
  4. Posting defamatory or abusive content
  5. Attempting to breach system integrity

Violation may result in suspension/termination of access and data may be retained for legal investigations.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

All reviews, comments, feedback or suggestions submitted by the User become the property of the Company. The Company is not obligated to maintain confidentiality of such content or compensate the User for it.

You agree not to post defamatory, obscene, unlawful, or abusive content and will be held liable for violations.

USER DATA

Users must ensure that details submitted on the Platform are accurate and updated. Inaccurate information may result in suspension of access.

The Company may use User information for service validation, analytics, and improvements in accordance with the Privacy Policy. User data may be shared with authorities if legally required.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property associated with the Platform including trademarks, text, images, and software belong to Dharmaz Enterprise and/or its licensors. Copying, modifying, or distributing Platform content without permission is prohibited.

LICENSE

A limited, non-exclusive, non-transferable license is granted to Users to access the Platform exclusively for personal and non-commercial use.

LIMITATION OF LIABILITY

The Platform, Services, and all related content are provided on an “as-is” and “as-available” basis without warranties. The Company is not responsible for:

  1. Any inaccuracies or disruptions of Services
  2. Loss of profits, data, or goodwill
  3. Damages arising due to third-party service providers

EXEMPTIONS TO LIABILITY OF COMPANY

The Company shall not be responsible for:

  1. Delays caused due to User inaction
  2. Incorrect User information
  3. Unforeseen conditions beyond Company control

The Company shall assist in cases of theft/accident of a vehicle while in service partner custody but shall not compensate unless such event occurs exclusively due to gross negligence of the Company.

BILLING / CHARGES

Charges are subject to change depending on actual work requirements. Work will proceed only after User approval.

Default in payment allows the Company to:

  1. Retain the vehicle until full payment is made
  2. Recover unpaid amounts as liquidated damages
  3. Sell the vehicle if dues remain unpaid beyond 90 days

DISPUTE RESOLUTION

In the event of disputes, matters shall be referred to a sole arbitrator appointed mutually, under the Arbitration and Conciliation Act, 1996.

The courts of Kanchrapara, West Bengal shall have exclusive jurisdiction.

GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of India.

GENERAL PROVISIONS

  1. Invalid clauses will not affect enforceability of remaining terms
  2. Non-exercise of rights does not constitute waiver
  3. Terms may not be transferred by the User without written consent
  4. All notices shall be emailed to User or posted on the Platform

TERMINATION

The Company may suspend or terminate account access for violation of these Terms. After termination, the User will no longer have access to account data stored on the Platform.

INDEMNIFICATION

Users shall indemnify Dharmaz Enterprise and its representatives against losses or claims arising from misuse of the Platform or breach of these Terms.
